Sex offender moves into South Nyak

A state-classified high-risk sex offender has moved into South Nyack, making the Orangetown village his third community since his status was first publicized by authorities in April.
Michael Koval, 33, moved to 61 Brookside Ave. last week. He had been living in Nyack at 312 High Ave. since early May after leaving Congers.
Koval served six months for first-degree sexual abuse involving two girls under the age of 11. He was convicted in 1996.
He was classified by the courts as a level 3 sex offender, allowing police to notify schools and businesses who care for children of his home address. He had been living in the county for nearly a decade.
The state's sex offender registry law requires an offender to report his address to the police department in the community where he plans to live.
Koval reported his Brookside Avenue address to the South Nyack-Grand View Police Department on June 20, Police Chief Robert Van Cura said yesterday.
The following day the Police Department notified the Nyack school district, the Nyack Library, day care centers and any businesses involved with children.
"He registered with us as he is required to do," Van Cura said. "We notified the Nyack school district the next day, as well as businesses like nursery schools with a vulnerable population such as children."
The law prohibits harassment or targeting of registered sex offenders because of their status.
Yesterday, Nyack school district families received letters from the district concerning Koval. The district usually mails 2,000 letters.
The district's letter gave Koval's name and address. Previously, the district did not provide the offender's name and address. The decision created discontent among some parents and led the district to change its policy.
The district, in previous letters, informed families that an offender moved into the area, provided a case number and ZIP code and referred people to the state Web site. When Koval moved into the district — from Congers to Nyack — in May, the district cited just Koval's registry classification number on the Web site.
Koval, described as 5-feet, 6-inches tall and about 210 pounds, has not been a problem for Clarkstown or Orangetown police when he lived in those jurisdictions.
Van Cura said he didn't expect any problems with Koval.

Sex offender sought by Ramapo police

RAMAPO — Police are looking for a high-risk sex offender who missed a court date this week.
Michael Koval, 33, was scheduled to appear Monday in Ramapo Justice Court to be sentenced for a conviction of failing to notify the state Department of Criminal Justice Services of his address, a misdemeanor.
The Level 3 sex offender, posing the highest risk of repeating the offense, was arrested in Ramapo on Aug. 11 after an investigation revealed he had moved from South Nyack to Montebello without notifying police.
A registered sex offender is required by law to notify a police department within 10 days of moving into its jurisdiction.
Koval had moved to 61 Brookside Ave., South Nyack, in June.
Later, Ramapo police, acting on a tip from South Nyack-Grand View police, found Koval had moved in with his girlfriend at 58 Lackawanna Trail, Montebello, in mid-July.
A warrant for Koval's arrest was issued by Ramapo Justice Samuel Colman when he failed to show up for his sentencing this week.
Ramapo police believe Koval is still in the county.
Koval was convicted of first-degree sex abuse, a felony, in 1996, after he was arrested in Clarkstown for abusing two girls, ages 6 and 9. He was sentenced to six months in jail and five years' probation.
Koval was sent back to jail in 2001 for violating the terms of his probation and was released in May 2003.
Koval is described as white, 5-foot-6, 210 pounds with brown hair and blue eyes.

Karben renews call for passage of Rockland sex offender law

Assemblyman Ryan Karben of Rockland County has called on the Rockland County Legislature to pass legislation he authored with County Legislative Vice-Chairman Robert Berliner and Legislator William Darden, ma jority Leader of the County Legislature, to protect Rockland children from sex offenders by better monitoring sex offenders in the community. Karben's call comes as a local high-risk sex offender disappeared this week after lying to officials about where he lives.
There are currently two pieces of legislation before the Legislature's Multi-Services Committee. One would set a date for a public hearing for a local law establishing the Systematic Tracking of s Program in Rockland. The other would call on the Rockland County Departments of Probation and Purchasing to prepare and advertise a Request for Proposal that would result in the County of Rockland tracking Level 2 and 3 sex offenders through Global Positioning System technology.
"If this law was in place, Michael Koval could not have escaped," Karben said. "It is clear that more needs to be done when it comes to keeping tabs on registered sex offenders. We need to protect our kids by making sure that offenders are where they say they are. Inaction is not an option."
Earlier this week, Michael Koval, 33, a Level 3 offender, missed a court date, at which time he was to be sentenced for lying to officials about where he lives. Police arrested Koval on August 11, 2005 for failure to notify the Department of Criminal Justice Services of his address. Offenders are required to notify DCJS within 10 days of an address change. Prior to his arrest, Koval had spent the past 25 days at his girlfriend's home in Montebello, right in front of a community playground – not at his registered South Nyack address. Ramapo police still seeking high-risk sex offender

RAMAPO — Police continue to search for a high-risk sex offender who skipped his court date last week.
A warrant for Michael Koval's arrest was issued by Ramapo Justice Samuel Colman on Dec. 19 when he failed to show up for sentencing on a conviction of failing to notify the state Department of Criminal Justice Services of his address, a misdemeanor.
Ramapo police Sgt. John Lynch said Koval, 33, called South Nyack police detectives to tell them that he was turning himself in. He still hasn't done so, Lynch said.
"At this point, he hasn't surrendered," Lynch said.
South Nyack Detective James Coyle said Koval called him last week after he learned police were looking for him.
"He claimed he was unaware of the warrant and said he would speak to his attorney to make arrangements to surrender himself sometime before the end of the year," Coyle said.
Koval's lawyer, Alvin Spitzer, said that he had spoken to his client and that Koval said he had made arrangements with the detective to come in next week, not by Dec. 31. Spitzer said Koval was home at his apartment in South Nyack. Koval moved to 61 Brookside Ave. in June.
"I don't know if it's going to be tomorrow," Spitzer said. "Koval told me that (Coyle) had told him that he could come in Monday or Tuesday. He hasn't talked to me since to tell me there's been a change."
Ramapo police had interviewed people in the South Nyack area who knew Koval to find out about his whereabouts. Koval told police that he had traveled upstate and that he didn't want to go to jail before the holidays, Lynch said.
"We have been actively out looking for him," Lynch said. "He had reported that he was away with his girlfriend but we believe she's back to work in Ramsey (N.J.), so we don't know where he is at the moment."
The Level 3 sex offender — the level posing the highest risk of repeating the offense — was arrested in Ramapo on Aug. 11 after officials found he had moved from South Nyack to Montebello without notifying police as the law requires.

Spitzer said Koval missed his court date Dec. 19 because he was sick the weekend before.
"We sent letters to the court but unfortunately there was a mix-up and that's why the warrant was issued," Spitzer said. "He had a serious medical issue. It wasn't that he was avoiding his appearance or trying to get out of his sentencing. Koval's been very good about appearing and facing the music."

Bill in Rockland Legislature focus on sex-offender tracking

State and Rockland officials want two sex offender-related proposals to go before the county Legislature, a goal hastened by the case of a local Level 3 sex offender who was jailed yesterday, two weeks after skipping a court appearance.
Michael Koval turned himself in to Ramapo police yesterday after he disappeared Dec. 19 and missed a court appearance to be sentenced for failing to notify the state Department of Criminal Justice Services of his new address.
"There aren't enough tools at the disposal of law enforcement to keep our communities as safe as they could be," Assemblyman Ryan Karben, D-Monsey, said.
Both bills have languished since their August proposal.
One looks to set a public hearing for a pedophile-tracking program that includes door-to-door notification when a sex offender moves into the neighborhood.
The other calls on the county departments of Purchasing and Probation to prepare and advertise a bid for the global positioning system, or GPS, tracking of Level 2 and 3 sex offenders.
The two bills were listed on the Nov. 17 agenda for the Legislature's Multi-Services Committee, but were pulled by committee Chairwoman Denise Kronstadt, D-Piermont, who listed the reason for doing so as "time restraints."
Kronstadt said she hopes the proposals will be on the committee's next agenda for a mid-January meeting.
Legislator William Darden, D-Hillcrest, said the sex-offender proposals were delayed because of the so-called "living wage" bill, which called for several Multi-Services Committee meetings in the fall.
"We didn't want either one to distract from the other," said Darden, a sponsor of the sex-offender proposals.
The Legislature passed the living wage bill Dec. 20, and County Executive C. Scott Vanderhoef vetoed it last week.
Karben, who has proposed similar laws at the state level, said current laws to track sex offenders are flawed because they depend on the offenders to keep law enforcement notified of their current addresses.
"I think that the Koval case demonstrates we cannot rely on sex offenders for honest information about their whereabouts," Karben said.
Koval was convicted of first-degree sex abuse in 1996.
Nanuet resident Laura McElhennon, mother of two small children, said she was in favor of tracking sex offenders through GPS.
"It's good to know who's in your area," she said. "You don't want them walking in the schools or anything."
McElhennon's husband, Liam, said he checks the state's online sex-offender registry — www.criminaljustice.state.ny.us and looks under Quick Links — to see if any offenders have moved into their neighborhood.

RAMAPO — Michael Koval, a high-risk sex offender, turned himself in to Ramapo police yesterday, two weeks after he missed his sentencing for failing to notify authorities of an address change.
Detectives had information that Koval was staying at a hotel on Route 17 in Ramsey, N.J. When they went there yesterday afternoon, they saw him in the hotel parking lot and advised him of the warrant, Ramapo Detective Sgt. John Lynch said.
Because the warrant was for a misdemeanor, police could not take Koval into custody or force him to comply, Lynch said.
But Koval went to the town Police Department voluntarily later yesterday, then was arraigned and sent to the county jail on $50,000 bail, Lynch said. Koval had been aware of the warrant for his arrest, Lynch said.
The warrant was issued after Koval failed to appear in Ramapo Town Court on Dec. 19 to be sentenced for failing to notify the state Department of Criminal Justice Services of his address, a misdemeanor.
"We had prior information from his phone conversations with South Nyack police detectives that he wanted to stay out of jail for the holidays," Lynch said.
A Level 3 sex offender, deemed the highest risk of offending again, Koval was arrested in Ramapo on Aug. 11 after he moved from South Nyack to Montebello without notifying police.
A registered sex offender is required to notify police within 10 days of moving into their jurisdiction. Koval is scheduled to return to Justice Court on Jan. 10.
Koval also is being charged by South Nyack-Grand View authorities with a felony violation of the sex offender registration law.
