Rabbi Yaakov Yitzhak Rata, who was convicted on charges of both rape and incest back in 1997. At the time he was sentenced to 16 years in prison. Upon his release from jail he inherited the title "rebbe" from his father. Passing the title of "rebbe" on to the children of deceased highly respected rabbis is a tradition very common amongst chasidic Jews. It's very similar to passing the title of King down to offspring of royalty.

Yaakov Yitzhak, who is in his 50s, has come out of prison straight into the leadership of one of the Shomeri Emumim communities scattered across the country.

One. Against the appellant filed with the District Court in Tel - Aviv - Jaffa charges (T.f. 3048/97), which are attributed to him counts of child abuse, domestic sexual offenses (rape and sodomy) forced indecent assault, sexual assault of a minor, indecent assault minor family members and impeachment investigation.
According to the indictment said the offenses were for ten years, at the appellant's brother, since she was eight years old. During this period, the complainant was given the responsibility of the appellant.

1. נגד העורר הוגש לבית המשפט המחוזי בתל-אביב-יפו כתב אישום (ת.פ. 3048/97), בו מיוחסות לו עבירות של התעללות בקטין, עבירות מין במשפחה (אינוס ומעשה סדום) מעשה מגונה בכפיה, תקיפה מינית של קטין, מעשים מגונים בקטין בן משפחה והדחה בחקירה.
בהתאם לכתב האישום בוצעו העבירות האמורות במשך כעשר שנים, בבת אחיו של העורר, מאז היותה כבת שמונה. בתקופה זו היתה המתלוננת נתונה לאחריותו של העורר.
עם הגשת כתב האישום, נתבקשה החזקתו של העורר במעצר עד תום ההליכים; ובית המשפט, לאחר שבחן את חומר הראיות - ונתן דעתו לכך שהעורר נעצר בדרכו להימלט מן הדין לארה"ב - נעתר לבקשה והורה בהתאם.
כנגד החלטה זו, הגיש ב"כ של העורר בקשה לעיון חוזר (ב.ש. 1382/97); כאשר בבסיס הבקשה עומדת העובדה, כי המתלוננת כבר העידה ואין על כן מקום לחשש שהעורר, אם ישוחרר, ינקוט צעדים כדי להשפיע עליה לשנות את עדותה.
ב"כ העורר הציע, כי העורר ישוחרר למעצר בית ב"דירת אירוח" שתועמד לרשותו על ידי משפחת פלדמן במושב תפרח; ומר פלדמן ובנו התחייבו לקיים פיקוח צמוד על מעשיו של העורר.
הבקשה לעיון חוזר נדחתה, כאשר בבסיס הדחייה עומדים, בסופו של דבר, שני טעמים: ראשית - משום שלא חל כל שינוי בענין החשש שהעורר ימלט מן הארץ, כפי שקבע השופט שדן בבקשה המקורית; ושנית - החשש של השפעה על המתלוננת לא פג, על אף שעדותה כבר נשמעה.
2. הערר מכוון כנגד הטעמים שהניעו את בית המשפט להורות על מעצרו של העורר עד תום ההליכים מלכתחילה; וכנגד הטעמים שניתנו לדחיית הבקשה לעיון חוזר.
כנגד ההחלטה המקורית, טוען ב"כ העורר כי בית המשפט טועה בכך: שלא מצא בסיס לערעור אמינותה של עדות המתלוננת במניע שהיה לה - לטענת העורר - להעליל עליו עלילת שוא; שלא נתן דעתו לכך, שעובר לעדותה בבית המשפט ניתנה למתלוננת אפשרות לעיין בחוות דעת של ד"ר היס, בקשר למימצאים שנקבעו על ידו בעקבות בדיקת קרום הבתולים שלה; ושלא קיבל את הסברו של העורר בקשר ל"בהילות" הנסיעה לחו"ל וקבע כי הנסיעה היתה מיועדת להתחמק מן הדין.
כנגד ההחלטה בבקשה לעיון חוזר טוען ב"כ העורר: כי שגה בית המשפט בסברו, שהחשש להשפעה על המתלוננת הינו בעל עוצמה הדוחה חלופת מעצר, על אף שהמתלוננת כבר העידה; וכי ניתן להבטיח שהעורר לא יתחמק מן הדין בתנאים מגבילים מתאימים.
לשיטתו של ב"כ העורר ניתן לקדם את פניהם של כל הסיכונים העומדים בבסיס מעצרו של שולחו במעצר בית מפוקח; ובמתן צו איסור יציאה המלווה בהפקדת דרכון.
3. טיבן של העבירות המיוחסות לעורר - שפרטיהן נפרשו בהרחבה בעדות שכבר מסרה המתלוננת - מקים לחובתו של העורר חזקה שבעובדה, שאם ישוחרר בערובה יעשה כל מאמץ על מנת להימלט מן הארץ ועל מנת להשפיע על המתלוננת לחזור בה מהעדות שמסרה; ותנאים מגבילים, לרבות אלו שהוצעו על ידי ב"כ העורר, אינם מקימים בסיס סביר לצפיה, שיהא בכוחם למנוע את הסיכון כפול הפנים האמור.

הרב יעקב יצחק ראטה, בנו הרביעי של האדמו"ר משומרי אמונים ישוחרר היום (ה') מכלא מעשיהו, לאחר שסיים לרצות את עונשו בגין מעשים מביכים בהן הורשע, כך קבעה לאחרונה וועדת השחרורים שליד השב"ס.
בסביבתו הגיבו לכך בשמחה רבה: "אחרי יותר מעשר שנים, הוא סוף סוף יוצא לחופשי", אמרו.

The former inmates said that Rata did not maintain good behavior while in prison. "Many prisoners did not like him because he was aggressive toward his friends," one of them said.
"How can a community of religious believers follow a person who was convicted of serious offenses which put him to shame?" asked another former prisoner. "It's inconceivable that he will now become a rebbe."
